After briefly analyzing the origins of the preliminary reference procedure and its devel- opment through the ECJ’s case law (which has also contributed, precisely through the preliminary rulings, to shaping the EU legal order), the paper examines the recent pro- posal to amend the Statute of the CJEU with a view to (among other things) transfer the jurisdiction pursuant to Article 267 TFEU to the General Court “in specific areas laid down by the Statute”. The contribution contextualizes the proposal having regard to the 2015 reform on doubling the number of judges of the General Court and highlights its criticalities, also speculating on possible solutions concerning its implementation through the Rules of Procedure of the Court and General Court
