Preavviso di rigetto, preclusioni, giusto procedimento e giusto processo [Rejection notice, preclusion and due process]

The paper analyses the institution of the rejection notice. Recent amendments in its discipline have introduced new limits to the exercise and re-exercise of administrative power. The current mechanism (envisaged in Article 10-bis of Law No. 241 of 1990), if properly interpreted by the administration, the citizen and the court, allows for a more balanced relationship between administrative proceedings and judicial process. This, consequently, offers better protection to the citizen, greater transparency of administrative action, a reasonable term of disputes settling between the administration and the private party, with a definitive ascertainment as to whether or not the good of life requested is due, where possible.

Lo scritto analizza l’istituto del preavviso di rigetto anche alla luce delle recenti modifiche normative che hanno introdotto nuovi limiti all’esercizio e al ri-esercizio del potere amministrativo. L’attuale meccanismo previsto all’art. 10-bis della legge n. 241 del 1990, se ben interpretato da amministrazione, privato e giudice, consente una più equilibrata relazione tra procedimento e processo e, conseguentemente, offre una migliore tutela al cittadino, una maggiore trasparenza dell’azione amministrativa, un ragionevole termine di chiusura delle controversie tra amministrazione e privato, con un definitivo accertamento sulla spettanza o meno del bene della vita richiesto, laddove possibile.
