The paper analyses the recent judgment of 9 July 2021, no. 148, by means of which the Italian Constitutional Court has completed the process of amendment of the notifications’ regulation, standardising the regulatory framework of void notifications provided by Article no. 44, paragraph no. 4 of Legislative Decree no. 104/2010 with the rule intended by Article no. 291, paragraph no. 1 of the Italian Civil Code for civil proceedings. In addition to the important repercussions on the notifications, the ruling is worth being discussed, because it radically innovates the administrative process, providing ground for a reconsideration, taking into account the criteria of reasonableness and proportionality, of some typical legal institutions, such as procedural time-limits and procedural issues.
L’art. 44, comma 4, c.p.a. è costituzionalmente illegittimo limitatamente alle parole “se ritiene che l’esito negativo della notificazione dipenda da causa non imputabile al notificante”, non consentendo sempre al giudice amministrativo di ordinare, qualora il destinatario non si sia spontaneamente costituito, la rinnovazione della notificazione nulla, come invece previsto dall’art. 291, comma 1, c.p.c.
