Through a retrospective analysis, the article discusses the labour law implications of the Just Transition. The article seeks to explain the rationale behind the link between labour law categories, trade unions identity and the energy transition from fossil-fuels to renewable energies. The author argues that the energy paradigm dominating in different phases of industrial capitalism contributed to shape labour law and trade unions ways of being.
L’articolo offre una analisi retrospettiva sulle implicazioni giuslavoristiche della c.d. Just Transition. L’obiettivo dell’articolo è spiegare le ragioni del legame che esiste tra categorie del diritto del lavoro, identità sindacale e transizione energetica dai combustibili fossili alle energie rinnovabili. Si sostiene che l’assetto energetico dominante nelle diverse fasi del capitalismo industriale abbia concorso a plasmare il modo di essere del diritto e della rappresentanza del lavoro.
