Regionalismo differenziato: un cammino a ritroso partendo dai più recenti accadimenti

Starting from an overview of the current complex situation of the pandemia, the paper aims at analyzing the difficult path of creating in Italy some Regions with extra powers and functions, according to the constitutional provision of art. 116, Section III of the Constitution, which envisages the possibility to create an intermediate level between existing ordinary Regions (regioni a statuto ordinario) and special Regions (regioni a statuto speciale) The most recent developments of the longlasting process of implementing the constitutional provision, i.e. the bill put forward in December 2019 by the Ministry for Regional Affaires, shows the unanswered and unsolved issues linked to the implementation of the Article itself. The critical elements of the bill impose a serious thinking on future possible solutions, with the ultimate aim to implement a virtuous process of differentiation, urgently needed because of the different characteristics that exist among the Italian Regions.

Il contributo analizza la difficile attuazione del c.d. regionalismo differenziato, previsto dall’art. 116 c. III della Costituzione italiana. Gli sviluppi più recenti del lungo processo di attuazione della disposizione costituzionale, ovvero il disegno di legge presentato a dicembre 2019 dal Ministero per gli Affari Regionali, mostrano le questioni ancora irrisolte legate all'attuazione dell'articolo stesso. Le criticità del disegno di legge impongono una seria riflessione sulle future possibili soluzioni, con il fine ultimo di attuare un virtuoso processo di differenziazione, necessario a causa delle diverse caratteristiche esistenti tra le Regioni italiane. Tale processo si rende ancora più urgente anche alla luce delle tensioni emerse nella gestione della recente emergenza sanitaria.
