The article analyses the recent reform concerning the Statute of the CJEU, in force since 1 May 2019. The Author examines the request of the ECJ of March 2018, the opinion of the Commission of July 2018 and the text finally approved by the EP and the Council in April 2019. The analysis is placed in the broader context of the previous reform of the 2015 of the Statute which led to the doubling of the number of judges of the General Court, keeping in due consideration the choice of the ECJ, of December 2017, not to transfer (at least for the time being) the preliminary ruling jurisdiction to the General Court “in specific areas laid down by the Statute”. Having regard to the ambitious proposal by the ECJ, which also contemplated the transfer of certain categories of infringement proceedings to the General Court, the contribution singles out some criticalities of the final amendments to Protocol No. 3, especially with regard to the new filter mechanism of appeals against the judgments of the General Court.
Il lavoro analizza la recente riforma dello Statuto della Corte di giustizia dell’Unione, in vigore dal 1° maggio 2019. L’A. esamina la richiesta della Corte del marzo 2018, il parere della Commissione del luglio 2018 e il testo infine approvato dal legislatore dell’Unione nell’aprile 2019. L’esame si colloca nel più ampio contesto della precedente riforma dello Statuto del 2015 che ha portato al raddoppio del numero dei giudici del Tribunale e della scelta della Corte, del dicembre 2017, di non trasferire (almeno per il momento) la competenza pregiudiziale al Tribunale «in determinate materie previste dallo Statuto». L’A. evidenzia come, nonostante il ridimensionamento della proposta originaria (viene infatti rimandata l’analisi dell’opportunità di trasferimento al Tribunale della competenza di alcune procedure di infrazione), le modifiche introdotte al Protocollo n. 3 presentino alcune criticità, specie con riguardo al nuovo meccanismo di filtro delle impugnazioni delle decisioni del Tribunale.
