The Italian Rules regarding Radio Frequencies : the Frameworks for the Electronic Communication Sector and the Broadcasting Sector

This essay reviews the Italian rules regarding the allocation of radio frequencies. The analysis reveals the existence of two different legislative frameworks – the Electronic Communication Code and the Broadcasting Consolidated Law – and investigates their relationship. First, this research focuses on general authorisation. Second, the research examines the conditions that limit access to the radio spectrum and the guidelines for granting individual rights. Particular attention is dedicated to allocation procedures (auctions or “beauty contests”). Third, the essay examines the relevant antitrust limits and the specific limitations governing the allocation of frequencies in the broadcasting sector. The last issue is an overview of the appeal system. Concluding remarks indicate the weaknesses of the system and suggest potential reforms.

Questo saggio passa in rassegna le norme italiane in materia di ripartizione delle frequenze radio. L'analisi rivela l'esistenza di due diversi quadri normativi, il Codice delle comunicazioni elettroniche e il Testo Unico della radiotelevisione, e indaga il loro rapporto. Per questo la ricerca si concentra, in primo luogo, sulla nozione di autorizzazione generale. In secondo luogo, la ricerca esamina le condizioni che limitano l'accesso allo spettro radio e le linee guida per la concessione dei diritti individuali. Particolare attenzione è dedicata alle procedure di assegnazione (aste o "beauty contest"). In terzo luogo, il saggio esamina i limiti in materia di concorrenza e le limitazioni specifiche che disciplinano l'assegnazione delle frequenze nel settore radiotelevisivo. L'ultima questione affrontata è quella delle modalità di ricorso avverso le decisioni sull'asssegnazione. Con le osservazioni conclusive, infine, si indicano i punti deboli del sistema e si esaminano alcune ipotesi di riforma.
