The paper, which introduces the Special Issue of the Review of European Litigation dedicated to the “jobs” of the Court of Justice of the European Union, examines the evolution of this institution over its (nearly) seventy-five years of activity. It outlines its transition from a “technical” interpreter of the internal market to a fully-fledged supreme court of a common legal system founded on values. Indeed, the study highlights how the protection of fundamental rights and the founding values set out in Article 2 TEU has become the new focal point of the Union’s judicial activity. In this context, the description of the “judicial machinery” is provided by its direct protagonists, who – through the contributions contained in this Issue – offer an “authentic” reading of the internal dynamics presiding over the formation of “Community” case-law.
Il lavoro, che introduce il Fascicolo Speciale della Rivista del Contenzioso Europeo dedicato ai “mestieri” della Corte di giustizia dell’Unione europea, esamina l’evoluzione di tale istituzione nel corso dei suoi (quasi) settantacinque anni di attività, delineando la transizione da interprete “tecnico” del mercato interno a vero e proprio giudice supremo di un comune sistema giuridico fondato sui valori. L’indagine, infatti, evidenzia come la tutela dei diritti fondamentali e dei valori fondanti di cui all’art. 2 TUE sia divenuta il nuovo baricentro dell’attività giurisdizionale unionale. In questo contesto, la descrizione della “macchina giudiziaria” è affidata ai suoi diretti protagonisti, che, attraverso i contributi contenuti nel Fascicolo, offrono una lettura “autentica” delle dinamiche interne che presiedono alla formazione della giurisprudenza “comunitaria”.
