The commentary examines the judgment of the Plenary Assembly of the Council of State No. 11/2024, which addressed the nature of the extraordinary appeal to the President of the Republic and the validity of the Presidential decree issued in the context of said procedure, despite the formal transposition of the case before the competent Court. The analysis first explores the reasons which led the Council of State to qualify the extraordinary appeal as an administrative remedy with judicial characteristics — thus overruling the prior case law which supported the so-called “substantially jurisdictional” nature of the extraordinary appeal — and to declare null and void, due to a complete lack of authority, the Presidential decree issued in violation of the rule provided by Article 8 of Presidential Decree No. 1199 of November 24, 1971. Then, the commentary focuses on certain critical aspects of the judgment, including some of the implications arising from the redefined nature of the extraordinary appeal to the President of the Republic.
Il commento analizza la sentenza dell’Adunanza plenaria del Consiglio di Stato n. 11/2024, che si è pronunciata sulla natura del ricorso straordinario al Presidente della Repubblica e sulle sorti del decreto decisorio reso in sede straordinaria nonostante la rituale trasposizione della causa dinanzi al Tar competente. Muovendo da un esame delle ragioni che hanno condotto il Collegio a ricostruire l’istituto in questione come un rimedio amministrativo di tipo giustiziale, prendendo così le distanze dagli orientamenti che avevano sostenuto la tesi della c.d. natura “sostanzialmente giurisdizionale” del ricorso straordinario, vengono poi analizzati gli argomenti che hanno indotto la plenaria a considerare nulli, per difetto assoluto di attribuzione, i decreti decisori adottati in violazione del principio di alternatività di cui all’art. 8 d.P.R. 24 novembre 1971, n. 1199. Infine, il commento si sofferma su alcuni profili critici della sentenza e sui precipitati della ricostruita natura del ricorso straordinario al Capo dello Stato, dall’analisi dei quali emergono dubbi circa la coerenza complessiva dell’impianto argomentativo della pronuncia.
