The case at hand addresses the issue of the starting point of the time limit for challenging the award of a public contract when the contracting authority — in breach of Article 36, paragraph 1 of Legislative Decree No. 36 of 31 March 2023 — fails to make the winning offer available at the same time as the communication of the award. After briefly outlining the relevant legal framework and the case law of the Court of Justice, the note examines the reasons why the court considered no longer applicable the case law developed under the previous Italian public contracts code, which required tenderers to request access to the documents within fifteen days from the award notice in order to benefit from the so-called “extension” of the time limit for challenging the award. Finally, the comment highlights some critical aspects of postponing the starting point of the action’s deadline to the moment when the defects of the award become actually knowable.
La sentenza in esame affronta il tema della decorrenza del termine per impugnare l’aggiudicazione nel caso in cui la stazione appaltante — in violazione dell’art. 36, comma 1, d.lgs. 31 marzo 2023, n. 36 — ometta di rendere disponibile l’offerta aggiudicataria contestualmente alla comunicazione dell’aggiudicazione. Dopo aver ricostruito brevemente il quadro normativo di riferimento, richiamando anche i rilevanti insegnamenti della Corte di giustizia, il commento analizza le ragioni che hanno condotto il collegio a non ritenere più applicabile quella giurisprudenza, elaborata nella vigenza del precedente codice dei contratti, che imponeva ai concorrenti di richiedere l’accesso agli atti entro quindici giorni dalla comunicazione dell’aggiudicazione al fine di potersi giovare della c.d. “dilazione” del termine per ricorrere. Si evidenziano, infine, alcuni profili critici del differimento del termine dell’azione al momento dell’effettiva conoscibilità dei vizi dell’aggiudicazione.
