The main object of this article is about the analysis of the space reserved for forensic eloquence in the doctrine of the late ancient regime, taking into account the works of authors such as Giovanni Battista De Luca, exponents of the Neapolitan environment and the Lombard Enlightenment, to then move on to frame the teaching of eloquence at the University of Pavia and the training institutions that competed with the Pavese Athenaeum especially in Milan. The last aspect examined concerns the judicial practice of Lombardy in the nineteenth century, an invaluable litmus test for the use by lawyers of eloquence, which lived through a particularly significant period during the Napoleonic era, both for the foundation of academies in which young aspiring lawyers were trained, with professional intent, in this specific subject, and for the application of a procedural law (Code Romagnosi - 1807) that finally gave space to the figure of the lawyer, making the debate public and thus allowing a revival in great style of the art of oratory, as evidenced by the statements collection of an outstanding barrister who was Giuseppe Marocco.
