This essay examines the Italian Constitutional Court’s case law on the relationship between domestic law and European Union law, highlighting the progressive erosion of the model established by Judgment No. 170 of 1984. This evolution, stemming from the Constitutional Court’s decision to maintain a central role within the multilevel system for the protection of fundamental rights, nevertheless risks, in light of more recent developments (Order No. 21 of 2025), placing the Court in a position of subordination to the Court of Justice of the European Union.
