The purpose of this contribution is to introduce the Focus Issue “Quo Vadis Advisory Func- tion?”, which is centered on recent developments in the advisory function administered by international judicial bodies, with particular reference to international courts and tribunals having both general and sectoral jurisdiction (respectively, the International Court of Justice, and the regional human rights courts). Indeed, recent practice has shown an increasing use of this jurisdictional form by States and international organizations to clarify the existence and the scope of application of international obligations that, in most cases, pertain to crucial ar- eas of the life of international relations today, including the action on climate change, the principle of self-determination of peoples and the respect of human rights.
Il presente contributo ha lo scopo di introdurre il numero speciale “Quo Vadis Advisory Func- tion?”, dedicato ai recenti sviluppi della funzione consultiva amministrata dal giudice interna- zionale, con riferimento alle corti aventi sia competenza generale che settoriale (rispettiva- mente, la Corte internazionale di giustizia e le corti regionali sui diritti umani). La prassi recen- te ha infatti evidenziato un crescente utilizzo di questa funzione giurisdizionale da parte di Stati e organizzazioni internazionali per chiarire l’esistenza e la portata applicativa di obblighi internazionali che, nella maggior parte dei casi, attengono ad ambiti cruciali dell’attuale vita delle relazioni internazionali, tra cui il contrasto al cambiamento climatico, il principio di auto- determinazione dei popoli e il rispetto dei diritti umani.
