Suicidio assistito e trattamenti di sostegno vitale : un possibile intervento da parte della Corte Costituzionale?

The preliminary investigation judge of the Court of Florence raised a question of constitutional legitimacy on Article 580 of the Criminal Code, as amended by Constitutional Court Sentence No. 242 of 2019, insofar as it requires that the non- punishability of a person who facilitates another person’s suicide be conditional on the circumstance that the aid is provided to a person “kept alive by life-support treatment,” for conflict with Articles 2, 3, 13, 32 and 117 of the Constitution, the latter in reference to Articles 8 and 14 of the ECHR. There would be no constitutionally relevant counter-interests placed in guaranteeing the prevention of access to assisted suicide for the person who is in the condition of not being dependent on life-sustaining machinery (see Judgment No. 242 of 2019).
