The paper focuses on the issue of EPPO’s prosecution and dismissal powers. Reconstructing the relevant legal framework allows to understand how the traditional reluctance of Member States to cede portions of sovereignty has produ ced “poisoned fruit”. This risked not only creating a body so unbalanced in terms of public security that it would jeopardise the protection of fundamental right, but also the objectives pursued with the creation of the new supranational Prosecutor.
