Building upon the main findings of the comparative studies on federalism and asymmetry, this article focuses on the unusual constitutional arrangement of the Kingdom of the Netherlands, which consists of a European part (the Netherlands) and a Caribbean part (comprising Aruba, Curaçao, St Maarten and the three public bodies of Bonaire, St Eustatius and Saba). The study complements the constitutional analysis of the Charter of the Kingdom of the Netherlands with a multiplicity of historical, economic, geographical and demographical factors. Although the Charter presents apparent federal traits, the number of de jure and de facto asymmetries characterizing the genesis of the Kingdom highlight that the historic-constitutional dimension (particularly the colonial legacy) and identity asymmetries between the European and the Caribbean part of the Kingdom are key to explain the constitutional design of the Kingdom and its ambiguities.
Lo studio muove dalle riflessioni dell’analisi comparata in punto di federalismi e asimmetrie per indagare l’inusuale architettura costituzionale del Regno dei Paesi Bassi, che si compone di una parte “europea”, i Paesi Bassi, e una parte “caraibica”, ovvero le isole di Aruba, Curaçao, Sint Marteen e le isole (municipalità speciali olandesi) di Bonaire, St Eustatius e Saba. L’assetto costituzionale che emerge dalla Carta del Regno dei Paesi Bassi viene integrato con elementi storici, economici, geografici e demografici. Nonostante i tratti federali pur presenti - per lo più “esteticamente” - all’interno della Carta, le asimmetrie de jure e de facto che segnano il processo generativo del Regno e la sua storia individuano nella dimensione storico-costituzionale (e in particolare nell’eredità coloniale) e nelle asimmetrie identitarie tra la parte europea e la parte caraibica del regno una delle cifre principali utili a spiegare l’attuale constitutional design del Regno e le sue profonde ambiguità.
