The essay dwells on certain application aspects, which appear problematic, commenting on the recent judgment of the Court of Justice AGCM v. Comune di Ginosa. It deals, on a general level, with the relationship between the Court of Justice's ruling and the Plenary Assembly nos. 17 and 18 of 2021 in those aspects where there is a certain asymmetry. It is then a question of the assessment in the present case of the direct effect of Article 12 of the Bolkestein directive and its consequences.
