Migration phenomena do not all have the same motivations. As such, the protection afforded to immigrants is not always the same; rather, it varies accord- ing to the individual's reasons for leaving the country. To make this clearer, differ- ent terms have been coined to identify different types of immigrants: "refugees," "asylum seekers," "displaced persons," "economic refugees," and "environmental refugees." It is necessary to clarify the scope of each term and to point out the differences between them, as they denote the legal status of unequal guarantees by international standards. The concept of transnationalism emerges within the context of the intensification of various types of migration flows within the broader concept of a 'globalization process'. Globalization, like other socioeco- nomic changes that came before it, has stimulated the development of new con- cepts that define new phenomena. In this work the constitutions of Argentina and Spain are analyzed in order to enlighten the condition of Bolivian migrants in these two countries.
