According to the well-established case law of the ECtHR, parties to the ECHR shall refuse recognition and enforcement of foreign judgments rendered in third country if the respondent’s rights were infringed during the proceedings in the State of origin. Yet, uncertainties remain as to the standard of review applicable by Court when carrying out such assessment. If the ECtHR has, at times, limited the review to “flagrant denials of justice”, in its more recent case law it has adopted a lower threshold, requesting a thorough assessment of the compliance of the foreign proceedings with the guarantees of fair trial. The decision in the case Dolenc v. Slovenia confirms this latter approach. The present work examines the possible implications of such decision, also with respect to the recognition of judgments from Parties to the ECHR and within the European judicial space.

Abstract
