Italian jurists were naturally open to comparative laws, mainly because of the country’s political situation. However, among the most significant changes that occurred in legal education at the turn of the 20th century were new teachings of modern comparative law. Indeed, legal methods went through a period of heated critical debate and comparative law started to be considered a very interesting field of study. This led to the development of new topics and the discovery of other legal traditions.

Abstract

Should comparative methods be considered a classic tool for XIXe century Italian jurists ? Italian jurists were naturally open to comparative laws, mainly because of the country’s political situation. However, among the most significant changes that occurred in legal education at the turn of the 20th century were new teachings of modern comparative law. Indeed, legal methods went through a period of heated critical debate and comparative law started to be considered a very interesting field of study. This led to the development of new topics and the discovery of other legal traditions.
Les méthodes comparatives constituaient-elles des outils classiques pour les juristes italiens du XIXe siècle ? Au vu de l’histoire politique du pays, comparer leur semblait en effet tout à fait naturel. Toutefois, ce n’est qu’à la fin du siècle, sur fond de crise de l’État libéral et de son droit, que le comparatisme acquiert des dimensions nouvelles. Alors que les méthodes d’enseignement du droit sont l’objet de débats critiques animés, un comparatisme nouveau se développe alors qui se présente notamment comme une véritable science du droit comparé, dotée de sa méthode propre et visant des traditions juridiques jusque-là ignorées.
