The lack of renewal of the General Council of the Judiciary (since December 4th, 2018) shows the need for structural reforms of this constitutional body. On one hand, it is necessary –dealing with the original meaning of the Constitution, the reports of European institutions and the doctrine of the Constitutional Court, the ECHR and the CJEU, – that Judges can elect directly a part of its members; on the other, reforms related to term expirations, majorities needed for nominations and powers of the Council while its mandate has expired should be implemented, in order to “depoliticize” and diminish the political influence on it.

Abstract

The lack of renewal of the General Council of the Judiciary (since December 4th, 2018) shows the need for structural reforms of this constitutional body. La falta de renovación del Consejo General del Poder Judicial (desde el 4 de diciembre de 2018) ha puesto en evidencia le exigencia de reformas estructurales de este órgano constitucional. Por un lado, se impone –de acuerdo con el espíritu de la Constitución, las indicaciones de las principales instituciones europeas y la jurisprudencia del Tribunal Constitucional, del TEDH e del TJUE– que los Jueces y Magistrados elijan directamente una parte de sus vocales; por el otro, son necesarias otras reformas sobre el régimen de prorogatio, las mayorías para realizar nombramientos o el marco de competencias del CGPJ en funciones, con el objetivo de “despolitizar” el órgano y sustraerlo a la influencia partidista.
