The contribution, taking inspiration from the judgments of the Court of Justice on the validity of Regulation 2020/2092, is divided into three parts aimed at exploring the possible consequences of using the conditionality mechanism on the nature of the EU. The first part analyzes the issue of the expansion of the instruments of conditionality in the European Union in order to highlight a trend of continuous expansion of the use of conditionality as a constitutional instrument of the Union; the second part deals with an aspect of constitutional importance, namely the relationship between solidarity and conditionality; finally, the third part looks at the impact of conditionality on the future enlargement processes of the Union.
