By means of a preliminary referral to the European Court of Justice, the Constitutional Court has suspended its judgment on the relevance of the principle “nemo tenetur se detegere” in a proceedings aimed at applying administrative punitive sanctions. Indeed, considered that the European law requires the States to sanction a lack of cooperation with the regulatory authorities of financial markets, it must be clarified if such an obligation is also applicable towards those who are suspected of having committed an offence and is compatible with the right to remain silent, protected both by the Constitution and by the European Charter of Fundamental Rights.
Utilizzando lo strumento del rinvio pregiudiziale alla Corte di giustizia, la Corte costituzionale ha sospeso il proprio giudizio di legittimità sulla rilevanza del principio del nemo tenetur se detegere nel procedimento per l’applicazione di sanzioni amministrative punitive. Rilevato, infatti, che il diritto europeo impone agli Stati di sanzionare la mancata collaborazione con le autorità di vigilanza sui mercati finanziari, occorre chiarire se tale obbligo valga anche nei confronti di chi è sospettato di aver commesso un illecito e se sia comunque compatibile con il diritto al silenzio, riconosciuto tanto dalla Costituzione quanto dalla Carta dei diritti fondamentali dell’Unione europea.

Abstract
