The increasing use of Artificial Intelligence systems within the world of law and, in particular, with reference to criminal proceedings stimulates important intellectual thoughts and debates. On one hand, there are for sure benefits, in terms of modernization, increasing of efficiency and quality of the justice. On the other hand, it is not possible to underestimate the necessity of a careful delimitation of those epistemic limits beyond which the different forms of Artificial Intelligence should not flow into the cognitive and evaluative platform at the criminal judge’s disposal, in order to protect the capacity, the solidity of the traditional structure of those fundamental rights and values on which the “fair trial” is grounded.
L’impiego sempre più diffuso di sistemi di Intelligenza Artificiale nel mondo del diritto e, in particolare, nell’ambito del processo penale stimola una riflessione che, senza trascurare gli innegabili benefici apportati in termini di modernizzazione ed incremento dell’efficienza e della qualità della giustizia, non sottovaluti, tuttavia, l'esigenza di un’attenta declinazione dei limiti epistemici oltre i quali deve restare preclusa, alle variegate forme di Intelligenza Artificiale, la possibilità di confluire nel patrimonio cognitivo e valutativo del giudice. E ciò al fine preminente di salvaguardare la tenuta dell’impianto tradizionale dei diritti e dei valori fondamentali sottesi al “giusto processo”.
