Considering the restrictive measures adopted in Italy, as in many other countries, to contain the SARS-CoV-2 epidemic, the authors analyse how technological tools can support controls on private activities; and how technological tools can effectively support the activities of public administrations. In this perspective, the authors’ attention focuses on some technological solutions used to help deal with the SARS-CoV-2 emergency, including the Immuni app created in 2020 by the Italian government. The author concludes that, to make such technological solutions truly effective, they must be widely spread among the population. Regarding the European rules on privacy and applying the principle of proportionality, the authors, therefore, investigate whether and under what conditions national authorities can impose the download of an app to citizens. The last paragraphs also account for the most recent developments related to the adoption of the EU Regulation of July 2021 on a framework for the issuance, verification and acceptance of COVID-19 Certificates.
Alla luce delle misure restrittive adottate in Italia, come in molti altri paesi, per contenere l'epidemia di SARS-CoV-2, gli autori analizzano come gli strumenti tecnologici possano supportare i controlli sulle attività private, nonché come gli strumenti tecnologici possano supportare efficacemente le attività delle pubbliche amministrazioni. In questa prospettiva, l'attenzione degli autori si concentra su alcune soluzioni tecnologiche utilizzate per far fronte all'emergenza SARS-CoV-2, tra cui l'app Immuni realizzata nel 2020 per il governo italiano. Gli autori concludono che, per rendere tali soluzioni tecnologiche veramente efficaci, devono essere ampiamente diffuse tra la popolazione. In merito alla normativa europea sulla privacy e all'applicazione del principio di proporzionalità, gli autori, quindi, indagano se ed a quali condizioni le autorità nazionali possano imporre ai cittadini il download di un'app. Gli ultimi paragrafi tengono conto anche degli sviluppi più recenti relativi all'adozione del Regolamento UE del luglio 2021 su un quadro per il rilascio, la verifica e l'accettazione dei Certificati COVID-19.
