Quali vie di ingresso legale per i richiedenti protezione in Europa? Contesto europeo e costituzionale

The paper provides an overview of protected entry procedures in Europe. To this end, the paper is divided into three parts aimed at analyzing: the protected procedures promoted by the EU, such as resettlement and humanitarian visas (Part I); the measures foreseen in national legal system, such as humanitarian corridors (Part II); the procedures introduced by some Member States, in particular France, Spain and Germany (Part III). The analysis will focus on the positive and critical aspects of these measures, especially in the light of the most recent humanitarian emergencies in Afghanistan and Ukraine.

L’articolo intende svolgere una ricognizione delle misure di ingresso protetto in Europa. A tal fine, lo scritto è suddiviso in tre parti volte ad analizzare: le vie di ingresso protetto promosse dall’UE, come i reinsediamenti e i visti umanitari (Parte I); le misure previste nell’ordinamento interno, come i corridoi umanitari (Parte II); le iniziative introdotte da alcuni Stati membri, in particolare da Francia, Spagna e Germania (Parte III). Nell’analisi si vuole porre l’attenzione sugli aspetti positivi e sulle criticità di tali misure, soprattutto alla luce dell’emergenze umanitarie più recenti in Afghanistan e Ucraina.
