I rapporti fra autonomia privata e disciplina italiana della vendita di beni di consumo, dopo il recepimento della Direttiva n. 2019/771

The EU Directive no. 2019/771 on certain aspects concerning contracts for the sale of goods, which repealed Directive 1999/44/EC, has been implemented in Italian law (Articles 128-135-septies cod. cons). After outlining the main differences between the oldest EC Directive 1999/44 and the new EU Directive no. 2019/771, this article focuses on analyzing the relationship between private autonomy and the limits set by the current Italian legislation on the sale of consumer goods, in the light of Article 135-sexies cod. cons. This legal provision raises several questions of interpretation, including that of coordination with other specific protection techniques aimed at sanctioning the abuse of private autonomy to the detriment of the consumer.
