In the context of the European Union, access to justice (and to the Court of Justice of the European Union) by NGOs active for the protection of the environment is granted through the peculiar system of judicial protection provided for by the Treaties, supplemented by the specific route established by Regulation (EC) no. 1367/2006, adopted following the accession of the Union to the Aarhus Convention. Over the years, this access has, however, proved difficult due to the restrictive case law of the Court of Justice of the European Union concerning the NGOs standing and interest in bringing action, according to art. 263, 4 ° c., TFEU, as well as for the intrinsic limits of the Aarhus Regulation. The paper, starting from a reconstruction of the current access routes to justice for NGOs in environmental matters, examines the recent instrument adopted for the reform of the Aarhus Regulation, namely Regulation (EU) 2021/1767, highlighting the critical and persistent issues and needs of modification, also in light of the interventions of the Aarhus Convention Compliance Committee.
Nell’ambito dell’Unione europea, l’accesso alla giustizia (ed in particolare, alla Corte di giustizia dell’Unione europea) delle ONG attive per la tutela dell’ambiente è garantito nel rispetto delle caratteristiche del sistema di tutela giurisdizionale disciplinato dai Trattati ed integrato dall’apposita via prevista dal Regolamento (CE) n. 1367/2006, adottato a seguito dell’adesione dell’Unione alla Convenzione di Aarhus. Negli anni tale accesso si è, tuttavia, rivelato difficoltoso per l’orientamento restrittivo della Corte di giustizia dell’Unione europea relativamente alla legittimazione e all’interesse ad agire delle ONG, in applicazione dell’art. 263, 4° c., TFUE, nonché per gli stessi limiti del Regolamento di Aarhus. Il contributo, dopo una breve ricostruzione delle attuali vie di accesso alla giustizia per le ONG in materia ambientale nell’Unione europea, esamina il recente strumento adottato per la riforma del Regolamento di Aarhus, ovvero il Regolamento (UE) 2021/1767, evidenziandone le criticità e mettendo in luce le perduranti esigenze di modifica, anche in considerazione degli interventi del Comitato di controllo dell’osservanza della convenzione di Aarhus.
