Una historia de nunca acabar : Sul travagliato rinnovo del Consejo General del Poder Judicial e del Tribunal Constitucional in Spagna

The paper deals with the recent delays in the renewal of the Spanish Council of the Judiciary (CGPJ) and a part of the Constitutional Court (TC). First of all, it will consider the rules (established both in the Constitution and in some Leyes Orgánicas) that apply, as well as the way the members of these institutions are chosen and the extension of their powers beyond the ordinary terms legally established (prorogatio). Then, attention will be paid to the political difficulties that sometimes arose while renewing the CGPJ and the TC, especially from the 2000s onward. Finally, some modest proposals will be drawn on the need of constitutional and legal reforms, in order to avoid future (and similar) breaches of the Constitution.

L’articolo esamina i recenti ritardi nel rinnovo del Consejo General del Poder Judicial (CGPJ) e di una parte del Tribunal Constitucional (TC) in Spagna. In primo luogo, si guarderà al quadro delle disposizioni normative (costituzionali e non) applicabili, nonché alle modalità con le quali i membri di tali organi sono eletti ed all’estensione del loro mandato oltre i termini ordinari (prorogatio). A seguire, si presterà attenzione alle difficoltà politiche che storicamente si sono verificate nel corso di alcuni rinnovi del CGPJ e del TC, soprattutto a partire dagli anni Duemila. Infine, saranno forniti alcuni spunti in relazione alla necessità di implementare riforme di natura costituzionale e legislativa, con l’obiettivo di evitare che siffatte violazioni della Costituzione possano ripetersi nuovamente.
