This contribution aims to examine and comment on the recent sentence “Carvalho and others v. Parliament and Council” with which the CJEU declared inadmissible for lack of active legitimacy the action for annulment presented on appeal by thirty-seven private subjects against some legislative acts adopted by the European Union (EU) to implement the obligations assumed after the Agreement of Paris. In particular, the contribution pays particular attention to the problematic aspects related to the access to climate justice in the EU and it aims both to verify whether the decision of the CJEU complies with the policies and role of the EU in the field of climate change, as well as to assess whether the strict interpretative criteria applied by the CJEU regarding the admissibility of the appeals do not risk weakening the protection of fundamental rights in the EU legal order.

Abstract

This contribution aims to examine and comment on the recent sentence “Carvalho and others v. Parliament and Council” with which the CJEU declared inadmissible for lack of active legitimacy the action for annulment presented on appeal by thirty-seven private subjects against some legislative acts adopted by the European Union (EU) to implement the obligations assumed after the Agreement of Paris.
