One of the last acts carried out by the so-called "Governo giallo-verde" (a majority based on the alliance between two parties identifiable with those colours, namely the League and the 5 Stars Movement) before its fall due to August 2019 crisis, was the conversion into law of the so-called "Decreto sicurezza-bis" (security-bis decree), which gives the Minister of the Interior the power to issue bans on entry into territorial waters to ships carrying irregular foreigners, providing for administrative sanctions of particular severity against violators. While the proposals to reform this decree struggle to find consensus among the new majority in office, and in any case do not appear to be in line with the indications provided by the President of the Republic at the time of promulgation, the Supreme Court of Cassation, intervening in the well-known case of the arrest of Carola Rackete, offers a reconstruction of the justification for the performance of duty to rescue at sea that in fact already sterilizes the effects of those sanctions. That said, the reform (or rather the abolition) of the security-bis decree remains a priority, especially to reduce the risks of chilling effect on the rescue of shipwrecked persons along the central Mediterranean route.
Uno degli ultimi atti compiuti dal Governo c.d. giallo-verde prima della crisi di agosto 2019 è stata la conversione in legge del c.d. decreto sicurezza-bis, che attribuisce al Ministro dell’Interno il potere di emanare divieti di ingresso nelle acque territoriali alle navi che trasportano stranieri irregolari, prevedendo sanzioni amministrative di particolare severità nei confronti dei trasgressori. Mentre le proposte di riforma del decreto faticano a trovare consensi nella maggioranza in carica, e comunque non appaiono in linea con le indicazioni fornite dal Presidente della Repubblica in sede di promulgazione, la Cassazione penale, intervenendo nel noto caso dell’arresto di Carola Rackete, offre una ricostruzione della causa di giustificazione dell’adempimento del dovere che di fatto già sterilizza gli effetti delle sanzioni. La riforma (o meglio l’abolizione) del decreto resta comunque prioritaria, soprattutto per ridurne i rischi di chilling effect sui soccorsi nel Mediterraneo Centrale e la conduzione dei naufraghi in Italia.
