The article analyses the decision no. 128/2021 of the Italian Constitutional Court, which declared the constitutional illegitimacy of the second extension of the suspension of executive procedures relating to the main house provided for by the so-called “emergency discipline”. This regulation, which provided for enhanced protection of the right to housing during the pandemic, will be examined, in addition to the decision of the Court. This, considering the more general recognition, in our Country, of the protection of the right to housing and, more specifically, in the context of balancing the interests of the landlord and those of the tenant.

Abstract
The article analyses the decision no. 128/2021 of the Italian Constitutional Court, which declared the constitutional illegitimacy of the second extension of the suspension of executive procedures relating to the main house provided for by the so-called “emergency discipline”.
