The growing spread of new technologies in the most diverse areas of daily life favors new ways of vulnerable consumer rights. It emerges an increasing possibility of errors or discriminations by big data, which could harm fundamental rights, laboriously obtained in contemporary legal systems, due to imperfect and of-ten opaque algorithms. This essay highlights the problem of discrimination through data analytics tools, underlining the ongoing legal debate between the United States and European Union, with particular emphasis on credit assessment tools; It also gives attention the common objectives developed in the framework of an ethi-cally sensitive approach to the regulation of artificial intelligence and related re-sponsibilities.

Abstract
