The article analyses the relationship between law and collective bar-gaining from the perspective of transitional law. The analysis focuses on coordination problems between existing collective bargaining provisions and changes in statutory legislation, with regard to two alternatives: the first one is conservative, meaning that existing contractual provisions will continue to be in effect; the second one regognises that collective bargaining provisions must adapt to changes in legislation. Based on the analysis of existing collective agreements and the new rules introduced by the so-called “Dignity law”, the article deconstructs the alternati-ve between the conservative thesis and the opposite one, suggesting the opportunity to address the issue with a case by case approach.
L’articolo analizza il rapporto tra legge e contrattazione collettiva nella peculiare prospettiva del diritto transitorio. L’articolo si soferma sui profli attuali del coordinamento tra disposizioni contrattuali vigenti e mutato quadro legislativo, con specifco riguardo a due possibili orientamenti: uno conservativo, favorevole cioè alla perdurante vigenza delle disposizioni della contrattazione collettiva; l’altro tendente a riconoscere la immediata sincronizzazione dei contenuti contrattuali alla sopravvenuta modifca delle previsioni di legge in concorso. Sulla base dell’analisi delle previsioni contrattuali in essere e dei cambiamenti legislativi intervenuti con il c.d. “Decreto dignità”, l’articolo decostruisce in modo critico l’alternativa netta tra la tesi conservativa e quella ad essa contrapposta, suggerendo la opportunità di valutare la questione caso per caso.
