It is a well-accepted truth that the community of property regime is definitively a failure in Italy, notwithstanding it is the statutory regime. A very high percentage of spouses living in Italy choose the separation of property regime. The paper tries to find out the deep reasons for this failure also looking at the history of the matrimonial property regime in Europe showing where the Italian statutory regime diverts from its two models: the French and the Spanish systems.
