The article traces the evolution of caducité in French Law through an analysis of doctrine and judicature up to the recent reform that has expressly regulated it in Articles 1186 and 1187 of Code civil. Given the similarity of caducité to the so-called « nullità successiva » (subse- quent voidness), the article deals with the issue of the admissibility of this figure under Italian Law and that of the regulation of its effects, in particular the question of retroactivity.

Abstract
