Il principio dell’iceberg : Scritture ad banchum iuris malleficiorum, Milano, secoli XIII-XIV

The Liber sententiarum comunis Mediolani dated to the six-month period July-December 1385 is the first register of the series Sentenze del podestà di Milano kept at Archivio Storico Civico - Biblioteca Trivulziana of Milan. It rapresents a part as derisory as it is difficult to specify in the proportions of what for the medieval period is yet kept of the criminal sentences discussed by the judges at the Loggia degli Osii of the city. However the wide range of documentary quotations that can be extrapolated from the Liber of 1385 and, before that, from the thirteenth century deeds of the Municipality of Milan allow us to indirectly point off a variety of judicial documents – previous, contemporaneous and/or subsequent to the Liber – once in existence and interconnected each other: manuscripts different in terms of material forms, organizational criteria, places and persons responsible for drafting, conservation and consultation. This heterogeneity highlights the plurality and the circularity of information that characterizes the management of the documentation drawn up since the thirteenth centuries by the criminal judges of Milan.

Il Liber sententiarum comunis Mediolani relativo al semestre luglio-dicembre del 1385, primo registro della serie Sentenze del podestà di Milano conservato presso l’Archivio Storico Civico – Biblioteca Trivulziana di Milano costituisce una parte tanto irrisoria quanto difficilmente precisabile nelle proporzioni di ciò che per il periodo medievale si conserva delle sentenze di condanna e discusse dai giudici ai malefici presso la Loggia degli Osii della città. L’ampia gamma di citazioni documentarie restituite dal Liber del 1385 e, prima ancora, dagli atti duecenteschi del comune di Milano permette però di analizzare indirettamente una molteplicità di documenti giudiziari– precedenti, coevi e/o posteriori rispetto al Liber – tra loro interconnessi: manoscritti diversi per forme materiali, criteri organizzativi, luoghi e responsabili di redazione, conservazione e consultazione tutti insieme nella loro eterogeneità indicativi della pluralità e della circolarità di informazioni che caratterizza la gestione delle scritture esistenti tra i secoli XIII e XIV a Milano, ad banchum iuris malleficiorum.
