The paper analyses the decision of the Court of Justice, as well as the opinions of the Advocate general, delivered in the case C-163/16 between the shoe designer Christian Louboutin and the Dutch company Van Haren, in the context of infringement proceedings where the “Red Sole” Benelux trade mark was challenged under Art. 3(1)(e)(iii) of Directive 2008/95/EC. Taking into account the reasoning of the CJEU, some considerations are proposed regarding the applicability of the functional exclusions to non-conventional trade marks, also in light of the new regime introduced by the European trade mark reform package.
Il contributo esamina la pronuncia della Corte di giustizia, nonché le conclusioni dell’Avvocato generale, rese nella causa C-163/16 che vedeva opposti lo stilista Christian Louboutin alla società olandese Van Haren con riguardo all’invocata applicabilità dell’esclusione funzionale di cui all’art. 3, par. 1, lett. e), iii), della dir. 2008/95/CE rispetto al marchio “suola rossa” registrato in Benelux. Alla luce delle argomentazioni svolte nella sentenza, sono proposte alcune considerazioni in merito all’applicazione dei suddetti motivi di nullità nei casi di marchi c.d. non convenzionali, tenendo conto anche dell’incidenza della nuova disciplina introdotta con la recente riforma del diritto UE dei marchi.
