The essay aims to investigate Cardinal Zabarella's original thought about the right of the defendant in the trail. It is possible to find traces of an embryonic protection of the accused in Zabarella's commentaria to clementina Saepe. His reflection rework more sistematically the insights which can be found both in the glossae by Bartolo da Sassoferrato to constitutio Ad Reprimendum and by Giovanni d'Andrea to clementina Saepe, where a natural right of defence has been drafted.
