This essay claims that, from a legal point of view, parents (and tutors) do not have the power to allow non-therapeutic injuries against minor children, and that this disability is also morally correct. Moreover, it is argued that there is no moral or legal reason why practices like tattoo or piercing should be an exceptions to this general rule, rather it would be better an enhancement of minors’ agency and autonomy.

Abstract

This essay claims that, from a legal point of view, parents (and tutors) do not have the power to allow non-therapeutic injuries against minor children, and that this disability is also morally correct. Moreover, it is argued that there is no moral or legal reason why practices like tattoo or piercing should be an exceptions to this general rule, rather it would be better an enhancement of minors’ agency and autonomy.
