The paper deals with the assessment of causation in criminal proceedings where company managers are charged with negligent homicide for workers’ or other people’s deaths due to mesothelioma. Such assessment turns out to be particularly problematic as long as the victim has suffered multiple or protracted exposures to asbestos. The first objective of the paper is to verify the extent to which the controversies arisen on the question of the c.d. "acceleration of failure time" stem from purely scientific uncertainties and to what extent, instead, they reflect authentic legal contrasts. The latter are found on both grounds of general and individual causation assessment. The second objective is therefore to develop proposals in order to overcome those legal controversies.
Il contributo esamina il controverso tema dell’accertamento del nesso causale nei procedimenti per omicidio colposo in cui la persona offesa, deceduta per mesotelioma, ha subìto plurime o protratte esposizioni ad amianto. L’obiettivo è verificare in che misura le oscillazioni giurisprudenziali che attualmente si registrano sulla questione del c.d. “effetto acceleratore” discendano da controversie squisitamente scientifiche ed in che misura, invece, riflettano autentici contrasti di carattere giuridico. Questi ultimi vengono in effetti ravvisati tanto sul terreno dei criteri di selezione della legge scientifica di copertura, quanto su quello dell’accertamento della causalità individuale, fornendosi di volta in volta indicazioni auspicabilmente utili alla loro ricomposizione
