This essay is an attempt to explain the reasons for which there is a lack in the international and national provisions concerning the right of asylum. It is basically an analysis of the conflict between the sovereignty of the Nation-State and the concrete protection and implementation of Human rights. I did not presented the results of my empirical research (concerning the situation of Darfur refugees in Italy) but I went trough the theoretical implications which brought to the contemporary legislation in the field.
