L'inadempimento dell'obbligazione di consegna nella vendita di beni di consumo : un difficile equilibrio tra tutela del venditore e tutela del consumatore

This paper deals with the analysis of Article 61 of the Consumer Code, which regulates the consequences of delay in the delivery of goods. In addition to the exegesis of the rule, special attention has been paid to the systematic coordination with the provisions of the Civil Code. The analysis highlights how the exceptions to the rules of the Civil Code are getting more and more relevant and difficult to deal with and how the remedies to protect the consumer increasingly seem to have an independent physiognomy that is difficult to refer to the institutes regulated in the Civil Code.
