The article describes the Egyptian constitutional path towards democracy, since the fall of Mubarak’s regime, through a comparison among the constitutional documents adopted following the 25th January Revolution. Egypt is experiencing a non-linear transitional process, reflecting the difficulties in realizing an adequate compromise between stability and representativeness, as a result of the internal struggle among the major players to prevail the one on the other. The continuous challenge from the Military and the Supreme Constitutional Court to the democratically elected Parliament and Presidency, finally led to the military coup d’état of July, 2013. The adoption of the new Constitution, in 2014, together with the recent presidential election, gave rise to a new political and constitutional phase, in which the achievement of a new balance of the interests involved appears as vital for the consolidation of the process.
