The paper proposes to carry out some further reflections on Perpetual Life Imprisonment (P.L.I.), waiting for the judgment of the Strasbourg Court. In the first part, the aim is to delimit the issue and to show a way to deal with it. In particular, the separation of powers and human dignity will be discussed, and two fundamental approaches to better frame the problem of P.L.I. will be developed. The first, a historical approach, with respect to the relationship between dissociation and collaboration with justice and the two versions of P.L.I. (1991 and 1992). The second, a sociological approach, referring to common experience. In the second part, the paper discusses the Life Imprisonment case law of the Court of Strasbourg, relating it to P.L.I. The article concludes by highlighting the roles that scholars, lawyers and judges can play to better address the issue of P.L.I.
Il presente scritto si propone di svolgere qualche ulteriore riflessione sull’ergastolo ostativo, in attesa della sentenza della Corte di Strasburgo. Nella prima parte, si delimita il tema e si propone un modo di affrontarlo. In particolare, si discute della separazione dei poteri e della dignità umana e si sviluppano due approcci fondamentali per meglio inquadrare il problema dell’ergastolo ostativo. Il primo, di tipo storico, rispetto al rapporto tra dissociazione e ostatività e tra le due versioni del regime ostativo, del 1991 e del 1992. Il secondo, di tipo sociologico, richiamandosi alla comune esperienza. Nella seconda parte, si discute della giurisprudenza della Corte di Strasburgo in materia di ergastolo, rapportandola all’ergastolo ostativo. Si conclude evidenziando i ruoli che possono ricoprire, per affrontare al meglio la questione dell’ergastolo ostativo, gli studiosi, gli avvocati e i giudici.
