The aim of this paper is to show the existence of a certain notion of rationality, which characterizes the cognitive approach to the study of legal reasoning. Firstly, the paper describes and discusses the Hartian conception of rational and causal connections between natural facts and legal or moral rules. Secondly, it shows that the cognitive approach aims to state the existence of connections of the second type, by trying to explain how people reason. Thirdly, it shows that the explanations provided by cognitive scientists can be used in the study of legal reasoning, in order to achieve certain aims, and that this use is characterized by a certain kind of rationality. Finally, the features of this kind of rationality are described.
Lo scopo di questo scritto è quello di mostrare l'esistenza di una determinata nozione di razionalità, che caratterizza l'approccio cognitivo allo studio del ragionamento giuridico. In primo luogo, lo scritto descrive e discute la concezione hartiana delle connessioni razionali e causali fra i fatti naturali e le regole morali o giuridiche. In secondo luogo, esso mostra che l'approccio cognitivo mira ad affermare l'esistenza di connessioni del secondo tipo, cercando di spiegare come le persone ragionano. In terzo luogo, lo scritto mostra che le spiegazioni fornite dagli scienziati cognitivi possono essere usate nello studio del ragionamento giuridico, allo scopo di conseguire determinati scopi, e che questo uso è caratterizzato da un determinato tipo di razionalità. Infine, le caratteristiche di questo tipo di razionalità vengono descritte.
