Le cooperative sociali : profili giuslavoristici

The essay deals with the regulation of social cooperatives, and in particular with labour law aspects. After examining the institution in the frame of the law n. 381/1991, with the distinction between cooperatives type a) and b), the author investigates the juridical relationships which bind these entities with the different individuals involved in them. So, the essay analyses the position of ordinary members, also in the light of law n. 142/2001, of disadvantaged members, voluntary members and workers who are not members. Then, the contribution goes on by describing collective aspects of the regulation, i. e. trade union rights, collective bargaining and worker participation in social enterprises (law n. 155/2006). The last section of the essay focuses upon social cooperatives type b) and their activity aimed at labour market integration of disadvantaged and disabled people, namely through the agreements provided by sect. 11-12-bis, law n. 68/1999 and sect. 14, legislative decree n. 276/2003. The author, after assessing positively the experience, points out some shortcomings in the regulation and suggests a restyling of the relevant law, profiting from the delegation law for the reform of the non-profit sector (law n. 106/2016).

Il saggio esamina la disciplina delle cooperative sociali, soffermandosi, in particolare, sui profili giuslavoristici. Dopo l’inquadramento dell’istituto nell’ambito della legge n. 381/1991,con la distinzione tra cooperative di tipo a) e di tipo b), l’autrice si occupa delle relazioni giuridicheche tali enti instaurano con i differenti soggetti in essi coinvolti. Viene, dunque, considerata la posizione dei soci lavoratori ordinari, anche alla luce della legge n. 142/2001, dei soci persone svantaggiate, dei soci volontari e dei lavoratori non soci. Il saggio passa quindi ad analizzare i profili collettivi della disciplina, toccando gli aspetti relativi ai diritti sindacali, alla contrattazione collettiva e alla partecipazione nell’ambito delle imprese sociali (legge n. 155/2006). L’ultima parte del contributo si focalizza sulle cooperative di tipo b) e sulla loro attività volta al reinserimento di soggetti svantaggiati e disabili, in particolare attraverso gli strumenti convenzionali offerti dagli artt. 11-12-bis, legge n. 68/1999 e dell’art. 14, d.lgs. n. 276/2003. L’autrice, dopo aver valutato nel complesso positivamente l’esperienza, richiama talune incongruenze incontrate nell’analisi della disciplina e suggerisce un restyling, sfruttando l’occasione della delega aperta nella legge per la riforma del cd. “terzo settore” (legge n. 106/2016).
