With judgment no. 52 of 2016, the Constitutional Court granted the “conflict of powers” appeal raised by the Government against the Supreme Court decision of 2013, in which it had been established the political, discretionary and non-justiciable act by which the Government refuses to start negotiations for the conclusion of an agreement pursuant to art. 8.3 Const. This essay reconstructs the lines of argument of the Constitutional Court, analyzing the doctrine that has commented the judgment no. 52, highlighting the key steps of the decision.

Abstract
