The article explores the tension between women’s rights and cultural defense, as a concept elaborated by the legal doctrine to achieve sub-stantive justice in multicultural societies. Some cases involving vio-lence against women that confirm the use of cultural argument for this type of crime are presented; the article reflects also upon the need, in criminal matters especially, to take into serious account the concept of culture, avoiding to make a reified use of it that is certainly harmful to women.
