This article deals with some issues related to the application of the new Italian law to cross-border couples, i.e. same sex couples with different nationalities, or same nationalities but living abroad. The recent decades have seen the rise of new forms of protection to couples outside traditional marriage (e.g. registered partnerships and same-sex marriages) in Europe and all around the world. Family law has undergone a radical change over the last twenty years or so. The amount of these couples is increasing. Regarding these couples, the new Italian law seems to leave some open issues on the possibility for them to conclude a partnership or to have their partnership or same sex marriage concluded abroad recognized in Italy.
